These Client Subscription Terms apply to every business that registers on the Starter Pack or Worker Management plan (the "Client"). They apply together with the 101KERJA Terms of Use and Privacy Policy. The Platform is provided by Innovate Digital Services Sdn Bhd (1480170-W) (the "Company"). Enterprise clients are governed by their signed Enterprise Agreement instead.

01. Registration and Company Information

The Client must complete all required company fields when registering, including its registered company name, SSM registration number, registered business address, contact person, telephone number and email address and any other fields on the registration form, and keep them accurate and up to date.

The person registering confirms that they are authorised to act for the Client. The Client is responsible for all activity under its admin accounts.

The Client is responsible for the accuracy of all information it submits, including company details, job details, rates and work locations. The Company may ask for supporting documents, such as an SSM registration certificate, and may suspend or close the account under clause 9 if any information is false, incomplete or cannot be verified.

02. Plans

Starter Pack (free): 5 free job postings per month, applicant tracking, an employer dashboard and 1 admin user. Additional job postings beyond 5 in a month are available for a fee under clause 6.7.

Worker Management: attendance, payroll, leave and rating modules for up to 3 admin users, with optional add-ons.

Current features, limits and prices are shown on the Pricing page at 101kerja.com/pricing.

The Client runs its own workforce. It recruits, engages, schedules, supervises, pays and ends engagements with its workers. The Company provides the software only and does not act on the Client's behalf or interfere in these decisions.

03. Engaging Workers

Any employment contract or gig service agreement is made directly between the Client and the worker. The Company is not a party to it. For gig work, the job details shown when the Client confirms a worker, including the parties, date and period, location, scope, rate and payment method, form part of the service agreement.

The Client decides whether it engages each worker as an employee or as a gig worker, and is responsible for that decision being correct in law.

Only Malaysian citizens and permanent residents may be engaged as gig workers. The Client must check that every worker it engages is legally allowed to work for it, including holding a valid work pass where required.

Every job posted must be accurate and lawful, meet minimum wage and working-hour laws, and must not discriminate on the basis of race, religion, gender, age, disability or any other ground prohibited by law. The Company may edit or remove any posting that breaches this clause.

The Client is responsible for workplace safety and site rules.

Clients must rate workers fairly and only on job performance.

04. Paying Workers and Statutory Obligations

The Company does not pay workers and does not receive, hold or transfer money for the Client or its workers. The Client pays its workers directly.

Employees. Where the Client engages an employee, the Client is the employer and is responsible for wages, overtime, leave, EPF, SOCSO, EIS, monthly tax deductions (PCB) and all other obligations under the Employment Act 1955 and related laws.

Gig workers. Where the Client engages a gig worker, the Client is the contracting entity and is responsible for complying with the Gig Workers Act 2025, including the service agreement, paying earnings within the agreed period (or within 7 days of completion where none is agreed), social security registration and contribution deductions under the Gig Workers (Social Security) Regulations 2026, and the rules on suspension and termination.

Payroll tools. The attendance, payroll and payslip features are tools. The Client must check the results, is responsible for the payments and deductions it makes, and must make sure its settings, such as rates, overtime rules and contribution rates, are correct.

A Client that supplies its workers to its own customers is responsible for every licence and registration its business requires, for its duties as an employer or contractor for labour, and for its contracts with its customers. The Company has no responsibility towards the Client's customers.

05. Data Protection

For worker records the Client creates or manages on the Platform, such as attendance, leave, payroll and payslips, the Client is the data controller and the Company is its data processor. The Company processes that data only on the Client's instructions and to provide the Services, keeps it secure, and helps the Client respond to its workers' data requests where reasonably required.

The Client must have a lawful basis for the personal data it enters, give its workers any notice required by the PDPA, and handle requests from its workers about their data.

The Client must keep Candidate CVs and other information it sees on the Platform confidential and use it only to recruit for and manage its own jobs.

06. Fees

Prepaid plans. Starter Pack is free, Worker Management and any add-ons are paid in advance. The Client chooses its plan, add-ons and the number of worker licenses for the monthly billing period and pays the full amount before the period starts. Paid features are activated once payment is received.

Worker licences. One worker licence covers one active worker for the billing period. If the Client needs more workers during a period, it must buy additional licences in advance, priced pro rata for the remaining days. Unused licences are not refunded or carried forward.

Prices and taxes. Prices are shown on the Pricing page at 101kerja.com/pricing when the Client pays. Fees exclude applicable taxes, which will be added where required. We will give at least 30 days' notice of any price increase, and it will apply only from the Client's next billing period.

Renewal. Each billing period renews automatically. We will remind the Client at least 7 days before the renewal date, and the Client may turn off renewal at any time before that date.

Non-payment at renewal. If payment for a new period is not received by the renewal date, paid features are paused and the account continues on Starter Pack features until payment is made. The Client can still export its worker records under clause 7.

Cancellation and refunds. The Client may cancel at any time. Cancellation takes effect at the end of the current prepaid period, and paid features remain available until then. Fees already paid are not refundable, except where required by law or where the Services are unavailable for a material part of the period because of our fault.

Additional Starter Pack job postings. Each Starter Pack Client may publish up to 5 job postings per calendar month free of charge. Unused free postings do not carry forward to the next month. Once the Client has used its 5 free postings in a month, each additional job posting in that month is charged at the fee shown in the employer portal when the Client creates the job posting, and must be paid in advance before the posting is published. Fees paid for additional postings are not refundable once the posting is published, except where required by law.

07. Client Data and Exit

The Client owns the worker records it creates on the Platform and may export them in CSV format at any time while its account is active and for 30 days after it closes. After that, we will delete or anonymise them, except where the law requires us to keep them.

08. Liability and Indemnity

Limits on the Company's liability.

  • (a) Maximum amount. The Company's total liability to the Client for all claims relating to the Services, whether in contract, tort (including negligence) or otherwise, is limited to the fees the Client paid in the 6 months before the event giving rise to the first claim. If the Client paid no fees in that period, the limit is RM100.
  • (b) Losses excluded. The Company is not liable for any loss of profit, revenue, business, contracts, goodwill or anticipated savings, or for any indirect, special or consequential loss.
  • (c) Client's own obligations. The Company is not liable for: (i) wages, contributions, deductions, taxes, penalties, interest or compensation the Client owes to its workers or to any authority, including where the Client relied on the Platform's payroll, attendance or payslip results without checking them as required by clause 4.4; (ii) loss caused by incorrect information or settings entered by the Client or its users; (iii) the acts or omissions of workers, Candidates or the Client's customers; or (iv) loss caused by the Client failing to keep its login details secure.
  • (d) Data. The Client is responsible for keeping its own copies of its worker records using the export function in clause 7. If data is lost or corrupted, the Company's only obligation is to use reasonable efforts to restore it from its most recent backup.
  • (e) Nothing in these Terms limits any liability that cannot be limited by law.

The Client is responsible for, and will indemnify the Company against losses, claims and reasonable legal costs arising from: its relationship with its workers, including employment and gig worker claims, workplace safety and any statutory payment or contribution; claims by its own customers; its job postings; and its breach of these Terms. This does not apply to the extent the loss is caused by the Company's own breach or negligence.

09. Suspension and Termination

If either party breaches a material term, the other may give written notice. If the breach is not remedied within thirty (30) days, the other party may terminate.

The Company may suspend or close the account of a Client that breaches these Terms, or whose information is false, incomplete or cannot be verified, after written notice. The Client can still export its worker records under clause 7.

10. Changes and General

We will notify Clients at least 14 days before material changes to these Terms take effect, except changes required by law.

These Terms are governed by the laws of Malaysia.
